The new transponders will be placed on your front headlamp or windshield. Please fill out the information below. You must attach an image of a registration for each transponder being requested.

Please note that key fobs will be distributed to HOMEOWNERS ONLY.

Renters are not permitted to request or pick up key fobs.
There is a limit of 3 key fobs per household at a cost of $25.00 each.
You will be required to provide a copy of your driver’s license for verification of name and Lexington Estates address. This will need to be confirmed as the correct information in the Superior Association Managements database.
If your address does not match an address within Lexington Estates, Palm Beach County Property Appraiser will be used as a secondary verification tool and supplemental information may be required.

Payments:

All payments must be made in advance of fob collection.

Collection dates will be communicated via email upon receipt of payment and verification of ownership.

Appointments can be made with Management for alternative payment and collection by emailing beth@superiormgmt.net.

If you lose your key fob, you are responsible for reporting it to management for immediate deactivation. You will be responsible for the use of the fob assigned to you and in the event there is damage to any property within the community or recreation areas by use of your assigned fob, you will be held responsible for such damage, which will be deemed an assessment or special assessment.

TERMS AND CONDITIONS

1. All applicants must be a Lexington Estates Homeowner and over twenty-one years old.

2. Rental must be for personal or family use. No business related functions.

3. A $100 security deposit is required with this application payable to Lexington Home Estates Association, Inc.

4. The applicant accepts full responsibility for all their guests and the pool shall be used on a non-interfering basis.

5. Applicant shall obey all laws. There are no firearms, explosives, or fireworks, allowed. No glass containers.

6. Applicant shall not nail, staple, tack, or deface the walls.

7. Applicant shall vacate the recreation area at the time specified and shall have left the premises in the same condition as found. This shall include but in not limited to:

a. Closing/locking all doors and gates

b. All trash shall be removed from the premises.

c. All parking signs and regulations must be observed. No Parking on grass or along street from rec. area to pumping station.

d. No excessive noise.

e. As per county ordinance the pool is open from sunrise to sunset.

8. The $100.00 fee will be refundable if all conditions are met.

9. Applicant shall not allow unsupervised minors in the facility at any time and shall further prevent any unauthorized or improper use of the facilities. Parents must supervise parties for minors and must be present at all times.

10. Indemnification: To the fullest extent permitted by law, applicant shall indemnify and hold harmless the Association and its members, agents and employees from and against all claims, damages, losses and expenses, including, but not limited to, attorney’s fees arising out of or resulting from the use of the subject Recreational Area hereunder. In addition, applicant shall be responsible for the acts and omissions of any of the foregoing, which shall result in any damage to the Association or Common Area property, or any liability to the Association. The applicant Owner shall be liable to the Association for it. Applicant agrees that the Association’s agreement to permit use of the Recreation Area(s) shall be sufficient consideration to applicant for the indemnification under this Agreement.

11. Any violation of any of the provisions of the Declaration of Restrictions and Protective Covenants for Lexington Home Estates, the Articles of Incorporation, the Bylaws, or any Rule or Regulation, by any guest or invitee of the applicant shall also be deemed a violation by the applicant, and shall subject the applicant to the same liability as if such violation was that of the applicant.

12. All outside vendors must supply License and Insurance information listed Lexington Home Estates as additional insured. Must be received prior to function.

13. This is not an exclusive use Agreement. Other residents and their guests cannot be denied use of the facility.

You cannot obstruct easements on adjoining properties, cause a nuisance or interfere with peace and privacy of the community. Homeowners and/or their licensed contractors are required and must obtain all required permits. Work must start within 45 days of recieving approval. Work to be completed within 90 days for all projects.

Only approved work may be completed, any modifications to the original application must be re-submitted, said approval can be revoked if different from application and modifications may be required to be removed at the owner’s expense.

The homeowner is responsible for complying with all Palm Beach County building codes and zoning requirements. After the ACB approval is granted, the homeowner must obtain the necessary permits. Once approved by PBC, the permit must be forwarded to management.

To comply with all state and local building codes

To comply with HOA conditions of acceptance (if any)

To complete the project according to the approved plans. If the modification in not completed as approved, said approval can be revoked and modification shall be removed by the owner at owner’s expense

I also understand that the HOA does not review and assumes no responsibility for the structural adequacy, capacity or safety features of the proposed construction, alteration or addition; for mechanical, electrical or other technical design requirements for the proposed construction, alteration or addition; or for the performance, workmanship or quality of work of any contractor.

I agree to abide by the decision of the ACB and/or the Board of Directors. If the modification(s) is not approved or does not comply, I may be subject to court action by the Association. In such event, I shall be responsible for all reasonable attorney’s fees.
